We currently have a vacancy for a Lawyer (Fitness and Probity) in the Enforcement Advisory Division on a specified purpose contract for approximately 12 months in duration. The role is on the Enforcement Directorate’s Fitness and Probity Authorisations Team. These roles are aligned with the Bank Professional 3 grade and the salary scale applies.  Please click here for further information on our salary scales.

It is important to us that our people have flexibility in their role and we will shortly transition to a hybrid working model where they can balance their time between working from home and our office.

Responsibilities:

  • Provide high quality legal advice and/or analysis, including assessment of legal risks, on matters referred to Enforcement in relation to the refusal of fitness and probity applications, firm authorisations and acquiring transactions. 
  • Advise on and lead pre-approval controlled function interviews.
  • Manage the conduct of referrals to RDU and the decision making process for opposition of Acquiring Transactions
  • Communicate with relevant stakeholders including management, supervision, Legal, and external legal advisers etc., to ensure a timely and appropriate response to both written and oral communications, and exercising excellent judgement in the escalation of matters arising to ensure that the appropriate matters are progressed properly.
  • Support the conduct of litigation, including appeals to the Irish Financial Services Appeals Tribunal and to the High Court. 
  • Take responsibility for own work outcomes and communicate these effectively within the team.
  • Work collaboratively with team members and across the Division as a whole, ensuring continuous knowledge sharing and development of best practice and procedure across the entire Division.

 Requirements:

  •  3 – 6 years post qualification experience as a barrister or as a solicitor.
  • Experience of regulatory/professional disciplinary law or procedural or administrative law.
  • Experience of working in a high pressured legal, professional services or regulatory compliance, or equivalent, environment.
  • Good knowledge and understanding of Enforcements procedural and legal framework, the work and role of the Central Bank and Irish financial regulation.
  • Experience of regulatory appeals or decision making desirable.
  • Experience of advocacy and regulatory interviews beneficial.
